1. INTRODUCTION

a. These Terms and Conditions apply to the “Invisalign and North Rocks $500 off Consumer Coupon Promotion” as set out below and they govern the contractual relationship between Invisalign and each Eligible Patient. Please read them carefully.

b. By redeeming the coupon with a Participating Practice, you agree to these Terms and Conditions.

2. PARTICIPATING PRACTICES
The following dental and orthodontic practices are participating in this Promotion (“Participating Practices”):

3. DEFINITIONS

a. “Eligible Patient” means an individual who meets all the eligibility criteria in clause 4 and 5.

b. “Invisalign” means Invisalign Australia Pty Limited ACN 098 357 736.

c. “Invisalign Providers” means registered orthodontists and general dental practitioners in Australia that are accredited with Invisalign and practice at a Participating Practice.

4. DISCOUNT AND ELIGIBILITY

a. Eligible Patients will receive a $500 discount off their Invisalign treatment with Invisalign Aligners (“Discount”) provided that the Eligible Patient:

i. attends the North Rocks Public School Fete on 30 August 2025 and visits the Invisalign stall;

ii. books their first Invisalign-related appointment with a Participating Practice on or before 31 October 2025;

iii. presents the valid coupon code “NR500” to the Participating Practice on or before their first appointment and before making payment or signing up for treatment with Invisalign Aligners.
The Discount cannot be applied after the initial prescription has been submitted by your Participating Practice and accepted by Invisalign;

iv. is deemed suitable for Invisalign treatment by an Invisalign Provider at the Participating Practice; and

v. have their prescription submitted and accepted by Invisalign on or before 31 December 2025.

b. The Discount is only available for individuals who are not already in active Invisalign clear aligner treatment at the time of applying for or redeeming the coupon.

c. The Participating Practice will apply the Discount to the total treatment cost and deduct this amount from the invoice issued to the Eligible Patient. The Eligible Patient is responsible for paying the remaining balance directly to the Invisalign Provider. For clarity, Invisalign does not collect any payment from the Eligible Patient and is not responsible for any fees charged by Participating Practice. Invisalign Providers at Participating Practices are not employed by Invisalign and are independent medical practitioners who are solely responsible for determining the fees that they charge for Invisalign treatment.

d. The following Invisalign products and services are excluded from this promotion and the coupon cannot be used to offset the cost of any of the following:

i. the Invisalign Palatal Expander System;

ii. additional aligners;

iii. replacement aligners;

iv. compliance indicators;

v. Vivera retainers;

vi. Invisalign Professional Whitening products;

vii. Invisalign Lens;

viii. Invisalign clamshell cases.

e. For the avoidance of doubt, the coupon cannot be used to off-set any consultation fees with your Participating Practice (including initial consultation fees and any fees for x-rays, PVS impressions and intraoral scans).

f. Your Participating Practice is solely responsible for ensuring the coupon code is correctly applied at checkout before submitting your prescription to Invisalign and for applying the corresponding discount to the total cost of your Invisalign treatment.

g. The coupon must be redeemed in a single transaction.

h. Coupons can only be used once by each Eligible Patient and cannot be transferred to any other party. Coupons are not gift vouchers.

i. Coupons cannot be exchanged or redeemed for cash or used in conjunction with any other coupons offered by Invisalign.

j. If you return or seek a refund on any item purchased using the coupon, the value of the discount will not be refunded to you and you will not be eligible for a further coupon.

5. INVISALIGN PALATAL EXPANDER SYSTEM

Subject to meeting the eligibility criteria in clause 4, patients being actively or previously treated with the Invisalign Palatal Expander System are eligible for this Promotion.

6. TREATMENT RESPONSIBILITY DISCLAIMER

a. The Discount provided is a promotional offer intended to be used toward your Invisalign treatment with an independently operated Participating Practice. Invisalign is not a healthcare provider and does not offer or deliver any dental or orthodontic treatment. The use of the coupon does not create a patient-provider relationship with Invisalign. All aspects of the Invisalign treatment, including consultation, diagnosis, treatment planning, and payment, are solely between you and your chosen Invisalign Provider. Subject at all times to your rights under Australian Consumer Law, Invisalign is not responsible for the quality, outcome, or cost of any treatment received and does not collect or process any payments related to your Invisalign treatment.

b. Receipt of the coupon does not guarantee eligibility for Invisalign treatment. Determination of a patient’s suitability for Invisalign treatment is at the sole discretion of the treating Invisalign Provider, based on their professional assessment acting independently. Invisalign does not participate in or influence this clinical decision-making process and makes no representations or warranties regarding a patient’s eligibility for treatment.

c. To the maximum extent permitted by law, Invisalign will not be responsible for your or the failure of your Invisalign Provider to perform any services related to this Promotion, or for any costs, damages, accident, delay, loss, expense, or inconvenience that may arise in connection with the use of the coupon.

7. EXTENSION OF PROMOTION PERIOD
Invisalign reserves the right to extend this Promotion at its sole discretion and without notice.

8. LIABILITY

a. SUBJECT TO CLAUSES 8(B) and 8(C), TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ALIGN ITS AFFILIATES, RELATED BODIES CORPORATE, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, OR AGENTS (COLLECTIVELY, ALIGN PARTIES) BE LIABLE FOR ANY SPECIAL INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES, HOWEVER CAUSED, AND WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE). NOT INCLUDING LIABILITY IN RELATION TO NON-EXCLUDABLE OBLIGATIONS, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED AU$500.

b. To the extent that you acquire goods or services from Invisalign as a consumer within the meaning of the Australian Consumer Law (being, the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth) as amended or replaced from time to time), you may have certain rights and remedies (including, without limitation, consumer guarantee rights) that cannot be excluded, restricted or modified by agreement. Nothing in these Terms and Conditions (including without limitation clause 8) operate to exclude, restrict or modify the application of any implied condition or warranty, provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other statute where to do so would (i) contravene that statute; or (ii) cause any term of these Terms to be void, (“Non-excludable Obligation”).

c. In relation to Non-excludable Obligations (other than a guarantee as to title, encumbrances or quiet possession conferred by the Australian Consumer Law), except for goods or services of a kind ordinarily acquired for personal, domestic or household use or consumption (in respect of which Invisalign’s liability is not limited under these Terms and Conditions), Invisalign’s liability to you for a failure to comply with any Non-excludable Obligation is limited to: (i) in the case of services, supplying the services again or payment of the cost of having the services supplied again; and (ii) in the case of goods, the cost of replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

9. GENERAL

a. This promotion is for a limited time only. Void where prohibited under local laws and regulations.

b. A provision or part of a provision of this promotion that is illegal or unenforceable may be severed from this promotion and the remaining provisions or parts of the provisions continue in force.

c. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Invisalign, Invisalign reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the promotion, as appropriate. Where reasonably practicable, we will provide you with at least 10 days' prior written notice of any required modification, suspension, termination or cancellation of this promotion, unless the immediate modification, suspension, termination or cancellation was required by law. If the modification is not material and/or to your detriment (so it is to your benefit or is neutral), we may notify you after we have made the change or not give you any notice.

d. This promotion and these Terms and Conditions are governed by the laws in force in New South Wales and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts which may hear appeals from those courts.

10. INTERPRETATION

In these Terms and Conditions, unless the contrary intention appears:

a. the singular includes the plural and vice versa;

b. a reference to ‘include' or ‘including' means ‘including but not limited to'; and

c. references to any statute or statutory provision includes any re-enactment or replacement thereof and will include any regulations or other subordinate legislation made under the relevant statute.
